Your Compliance Responsibility for Replacements
As a reminder, when discussing potential policy replacements, your responsibilities are not just company expectations, they are grounded in California law. The California Insurance Code (§§ 10509—10509.8) establishes clear standards designed to ensure clients receive the information needed to make decisions in their best interest.
If a replacement may be involved, you are required to take specific steps at the time of application. This includes obtaining signed statements, providing the required “Notice Regarding Replacement,” leaving copies of sales materials with the client and documenting existing policies to be replaced. These steps are not optional; they are core compliance obligations under California law and a requirement of your appointment with Mutual of Omaha.
It is equally important to ensure that any comparison between existing and proposed coverage is accurate and complete. California law specifically prohibits recommending a replacement based on materially inaccurate or misleading comparisons and identifies unnecessary replacements as a compliance violation.
As a result, every effort should be made to gather and retain as much information as possible regarding the client’s existing coverage. This includes policy details such as benefit structure, premiums, riders, surrender charges, contestable period and any other relevant features that may impact the comparison. Having complete and accurate information about the existing policy is critical to ensure that any comparison to proposed coverage is fair, balanced and well-supported. Thorough documentation of the existing coverage not only strengthens the basis for the recommendation but also helps demonstrate compliance with regulatory requirements and the client’s best interest.
Consistent with these requirements, Mutual of Omaha expects brokers to provide balanced information, document the basis for recommendations and ensure every replacement is in the client’s best interest.
